Trax4Life Licensing
Trax4Life Media has two level of licensing.
Individual licensing: Basically gives you the right as the purchaser to use the Audio adventures and photocopy the worksheets for your own use such as classroom, goups an educator, group leader, homeschooler up to forty copies at one time.
END USER LICENSE FOR TRAX4LIFE MEDIA PRODUCTS
THIS IS A LEGAL DOCUMENT. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE USING TRAX4LIFE MEDIA PRODUCTS. THIS LICENSE PROVIDES IMPORTANT INFORMATION CONCERNING THE DIGITAL PRODUCT (S), PROVIDES YOU WITH A LICENSE TO USE THE PRODUCT (S) AND CONTAINS WARRANTY AND LIABILITY INFORMATION. BY USING OUR PRODUCTS, YOU ARE ACCEPTING THE PRODUCTS “AS IS” AND AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT. IF YOU DO NOT WISH TO BE LEGALLY BOUND BY THIS AGREEMENT, DO NOT USE OUR PRODUCTS
1. Terms of License
This license allows you to:
(a) use the Products on a single computer; and
(b) make one (1) copy of the Products for back up purposes.
If you wish to use the Products on more than one computer, you must purchase another licensed copy of the Products for each computer on which you want to install the Software.
2. Restrictions on Use
Unless Trax4Life Media has authorized you to distribute their products, you shall not make or distribute copies of their Products-including PDF, MP3s, CD Audio- and any other media or transfer the products from one computer to another. You shall not decompile, reverse engineer, disassemble, include in other software, or translate the Products, or use the Products for any commercial purposes. You shall not modify, alter, change or otherwise make any modification to the products or create derivative works based upon their products. You shall not rent, lease, resell, sublicense, assign, distribute or otherwise transfer their products or this license. Any attempt to do so shall be void and of no effect. Reposting Trax4Life Media products online is strictly prohibited.
3. Ownership
This license provides you with limited rights to use their Products. Trax4Life retains all ownership, right, title and interest in, to and of their Products and all copies of it. All rights not specifically granted in this license, including domestic and international copyrights, are reserved by Trax4Life Media.
4. Proprietary Markings
Trax4Life Media logos, product names, manuals, documentation, and other support materials are either patented, copyrighted, trademarked, constitute valuable trade secrets (whether or not any portion of them may be copyrighted or patented) or are otherwise proprietary to Trax4Life Media. You shall not remove or obscure Trax4Life Media copyright, trade mark or other proprietary notices from any of the materials contained in this package or downloaded together with their Product (s).
5. Disclaimer of Warranties and Technical Support
Their Product (s) are sold to you free on an “as is” basis, without any technical support or warranty of any kind including, without limitation, any warranty or condition of merchantability, fitness for a particular purpose and non infringement. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.
6. Limitation of Liability
TRAX4LIFE SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LOSS, INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, OR THE LIKE, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF TRAX4LIFE OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. This warranty gives you specific legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction.
7. Term and Termination
This license agreement is effective until terminated. You may terminate this license agreement at any other time by destroying all complete and partial copies of their Product (s) in your possession. This license and your rights hereunder shall automatically terminate if you fail to comply with any provision of this license. Upon such termination, you shall cease all use of their Products and delete the Products (such as digital files) and destroy all copies of the Products and other materials related to the Software in your possession or under your control.
8. General Provisions
(a) This Agreement shall be governed by the laws of the Province of Saskatchewan, Canada.
(b) This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
(c) All questions, comments or concerns with respect to this Agreement shall be directed to:

9.LEGAL COMPLIANCE
Company may suspend or terminate this Agreement or User’s use immediately upon receipt of any notice which alleges that User has used this site for any purpose that violates any local, state, federal or law of other nations, including but not limited to the posting of information that may violate third party rights, that may defame a third party, that may be obscene or pornographic, that may harass or assault others, that may violate hacking or other criminal regulations, etc. of its agents, officers, directors, contractors or employees. In such event, Company may disclose the User’s identity and contact information, if requested by a government or law enforcement body or as a result of a subpoena or other legal action, and Company shall not be liable for damages or results thereof and User agrees not to bring any action or claim against Company for such disclosure.
This site (excluding third party linked sites) is controlled by the Trax4Life Media from its offices within the Province of Saskatchewan, Canada. It can be access from all Canadian Provinces and territories as well as from other countries around the world. As each of these places has laws that may differ from Saskatchewan, Canada, by purchasing from Trax4Life Media, both you and the Trax4Life Media agree that the statues and laws of the Province of Saskatchewan, Canada, shall apply to any actions or claims arising out of or in relation to this Agreement or your use of Trax4Life Media’s product (s) or web site, without regard to conflicts of laws principles thereof. You and the Trax4Life Mediaalso agree and hereby submit to the filing of any claim only in the exclusive personal jurisdiction and venue of the province of Saskatchewan, Canada and any legal proceedings shall be conducted in English. Trax4Life Media makes no representation that materials on their site or that they produce are appropriate for all audience or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. This Agreement shall not be governed by the United Nations Convention on Contracts for the Goods.
